¡DON´T HAVE SEX IN YOUR CAR!

Having sex in a car isn´t illegal, there is no jurisdiction in the United States with a prohibiting law; however, laws are different from state to state, and under some circumstances, it can be considered an offense and those involved may be fined, charged with a crime and even arrested.

Basically, as long as the act is consensual and takes place in a private vehicle, it is not considered illegal. Nevertheless, depending on the state, you could face charges in the following cases:

  • If it is considered a public act. In general, it is illegal to have sex in a vehicle in public places, where someone can witness the activity; it is considered disorderly conduct and may lead to arrest.
  • If the vehicle is parked on private property: The property owner has the right to call the police and it can become a legal issue.
  • If you have sex with the vehicle in motion: If caught while the vehicle is being driven and you are casually pulled over for a traffic violation, you most likely end up receiving charges.
  • If there are noise ordinances: Even if you are in a private place if the state has noise ordinances and you are reported to the police, you might still be in legal trouble.

It is the act of indecently exposing oneself in a sexual manner to alarm or offend others, which is considered a criminal offense. It refers to reckless or even purposeful displays of sexual activity in a public place and in view of others.

Locations in public view, concurred by pedestrians, drivers, and people in general that are passing through. These are some examples of public places:

  • Office parking spaces

  • Alleyways

It depends on each state where you get caught; there is no one and only law regulating car sex, but it is a rule of thumb that if it happens in a public place, you may be fined or even arrested and there could be additional charges for indecent exposure and public sex.

It is legal to have sex in your car as long as there is privacy, within your private property or where nobody witnesses the act.
